Brickell Wallstreet Capital (“we,” “us,” or “our”) may provide loan applications, disclosures, term sheets, closing documents, notices, and other records to you in electronic form rather than paper. By checking the electronic consent box and submitting your application or using our Services, you consent to receive and sign these records electronically.
1. Your Electronic Consent
By providing your electronic signature and consent, you agree that your electronic signature has the same legal effect as your handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”) and any applicable state Uniform Electronic Transactions Act (“UETA”) or equivalent law.
2. Scope of Consent
Your consent applies to all documents, communications, and records related to your loan application, underwriting, term sheets, closing, servicing, and any ongoing relationship with us and our certified lenders, brokers, and capital partners. This includes but is not limited to applications, disclosures, authorizations, approvals, notices, and correspondence.
3. System Requirements
To access, view, and retain electronic records, you will need a device with internet access, a current web browser, and the ability to open PDF documents. You confirm that you have access to the necessary hardware and software and that you are able to receive, open, print, and retain electronic records.
4. Requesting Paper Copies
You may request a paper copy of any electronic record at no charge by contacting us at info@brickellwsc.com or (561) 870-1213. We reserve the right to charge a reasonable fee for repeated or excessive paper-copy requests.
5. Withdrawing Consent
You may withdraw your consent to receive electronic records at any time by contacting us using the information above. Withdrawal of consent will not affect the legal validity or enforceability of any electronic records or signatures previously provided. If you withdraw consent, we may discontinue electronic delivery and may require paper-based processing, which could delay your application.
6. Updating Contact Information
You are responsible for keeping your email address and other contact information current in your account profile. Failure to maintain accurate contact information may prevent you from receiving important electronic notices.
7. Audit Trail
Each electronic signature is recorded with an audit trail that may include the signer's identity, timestamp, IP address, browser metadata, and the document version signed. This audit trail is maintained to support the enforceability of the electronic record.
8. Questions
If you have questions about electronic signatures or these consent disclosures, please contact us at info@brickellwsc.com or (561) 870-1213.
